As a seller, it seems to me that if I am asked to pay the Realtor (Buyers Broker), then that Realtor works for me, not the seller. I'm no Lawyer, but if I (the seller) am paying for those services, the Realtor should be legally obligated to work on my behalf, not the seller, including telling me the bottom line on what the Buyer is prepared to pay for the house. If the Buyer really wants protection, they should pay the Buyers Broker themselves, and no good home buying transaction should be handled without the representation of a Real Estate Attorney. Real Estate agents are not Attorneys, although they would like you to think they are, and I doubt if they are on the hook for legal mistakes they might make during the transaction. Just my 2 cents.
Can you back out of the sale of house when the contract expired because the loan doc was not ready?
This is an exceptional podcast to listen to fully. They all are. In this case hearing your experience and understanding that when my agents and I simply read and follow SC 40 - 57 you can avoid most trouble gives me a sense of peace and a renewed focus on that message. Also enjoyed hearing Covid facts and figures.
You’re normally much nicer in your videos. At least you added in the free website resource! A little bit of an edge with a gift works perfectly!
For clarity though, the buyer can still ask for the seller to pay closing costs and non allowable VA closing costs are something that the seller can pay for for the buyer. So if you are short on the commission because the co-broke fee is less than what you agreed upon with the buyer then the buyer can ask for that difference to be paid for as part of the closing costs that are being paid for by the seller for the buyer. (Paragraph 5 in the CCRA contract).
What if the buyer has buyers remorse. And never delivers the earnest money? I had a buyer who thinks she can terminate within 3 days. I told her real estate contracts are different its not like buying a car. Real Estate contracts are as read and explained. We have follow it to the letter. Buyer won't sign a termination. Or a release, nothing to release, they didn't turn on earnest. I consider this a breach of contract terms. They go silent. How would you handle this?
