Hello, Kwan! First of all, I would like to thak you for the videos! I have a question. How can I find what is the righ calculation for the HS code? For example, I have a client who is Exporting from Brazil to USA material with the 8432.90.00.60 HS code. According to the Origin rules facilitator, the RVC is 93%. But, which calculation is correct? Build -up, Build-down or MC?
Hi, it depends on the FTA rule, PSR(product specific rule). Even though the PSR allows both Build-up and build-down, the threshold rate is different like Build-up 45% and build-down 30%. You need to check the rule and ask the client how did he/she calculate the RVC.

If a company based in Vietnam for example imports raw materials worth $1000 from India, then this $1000 is to be included as material cost for RVC calculation? Can you please help me here?

if RVC 100 % , then how to calculate
We can think of it in two cases : Build-up and Build-down. In the case of build-down where RVC = (AV-VNM)/AV. We can accomplish 100% if VNM is zero. The other case build-up, on the other hand, where RVC = VOM/AV. To get 100%, VOM should be equal to AV and it will not be possible.

Dear Kwan Woo, thank you for these videos. I am learning a lot. But instead of saying "it does not satisfy CTH rule", I think you should say, "it does not require a tariff shift". This is a much easier way for novices (like myself) to understand what this means practically speaking, in the business world.
Does it fall in the ambit of WTO as MFN
A MFN(most-favored-nation ) is one of the clauses of WTO principles. It requires member countries to treat all countries equally. FTA is the exception of the MFN clause.

Hi. May I know if this is the reason why the importer needs to apply for the Cert of non-manipulation acquired from the third country where they are being changed from a 1st vessel to a 2nd vessel?
The customs officers in the importing country need to know that the product was kept under the customs control in the third country. The Cert of non-manipulation acquired from the third country is one of the ways to prove that the product was kept under the customs control in the third country. Hope this answers your question.

Thank you Funiwe Dlamini, Regarding the difference between preferential ROO and Non-preferential ROO, it's very simple. Preferential rules of origin are the rules only for preferential duties(tariffs). On the other hand, non-preferential ROO are the rules for the rest regulations other than duties(tariffs). The examples of Non-preferential ROO are marking of origin and trade statistics. It is operated by each country based on its domestic regulation. My videos are focused on preferential ROO. But the concepts, for example tariff shift rules, RVC rules, de minimis rules, are very similar. If you have more questions feel free to ask me. Kim Kwan-woo, Joseph
