It may not always be as neat and orderly as this. In my situation, I had a former sibling, who decided she’d been the executor, since before our mother passed (stop laughing), that she’d block probate from everyone happening, which is east to do since, being uncooperative may mean, to a lawyer, that the case is contested and, like myself, you may need to represent yourself (pro se). While deeds to the 2 properties have been distributed, the court has allowed this former sibling to drag the case out an extra year, still vying for the property I’ve inherited, and missing 4 personal property exchange dates. I’ve made a motion to vacate the previous order, to have another personal property exchange date. Waiting to see what happens shortly.

@@richardmahoney4531 according to my insurance agency, UM does not cover passengers. It only covers the name insured on the policy.

This video is excellent. In my experience, the only thing I would add is a court appointed trustee using a market sale of the joint owned property is optimal in my opinion and experience.
I’m in TN and my brother died two years ago without a will. No wife, no children, my two sisters and I were designated the heirs. The three of us decided to give POA for our youngest sister to be assigned as Administrator. Big mistake. She is the busiest one of us all, is an artist with no business sense. I am the business major. Through texts, the three of us made decisions and talked things over. Her and my bipolar older sisters who has always resented me, turned down what I thought, and friends who heard too, some sound business things that could have brought us more money. They both pretty much stopped talking to me last year and I was not involved in any decisions after a point, I still don’t even know what happened to two of his vehicles I made offers on. Probate hearing coming up in September. Will I have a chance to speak? Like if I made an offer on three vehicles, and they were sold elsewhere, why, for the benefit of the estate, was I not given an opportunity to counter the other bid. Shouldn’t this be the objective of the Administrator, to make the most lucrative decisions about the estate? For the benefit of all three of us? After I made my offer on the vehicles, the next time I went to my brothers house, they had relocated them all, and I’ve yet to hear what they were sold for and to whom. Someone said since we waived to inventory the estate, we may have waived the right to see the details of the final accounting of where money came and went. I don’t want to act like a resentful sister in court, if I am allowed to speak, but I feel numerous decisions were made to spite me, possibly making the same money, but not giving me an opportunity to offer more, or to pay the same so I could flip some items and make a profit, which was done in two cases, I wasn’t given a chance to counter so I could fix and flip. I first asked to do this for the benefit of us all, but when rejected by both sisters, I made my own offers so I could make a profit. Will I get a chance to speak and what do you suggest my demeanor be? Thank you for any guidance.

In many instances, the administrator of the estate does have wide discretion in the sale of estate assets such as vehicles. The administrator must, however, act in the best interest of the estate by properly valuing estate assets and obtaining fair value for assets that are sold. My mother did a Lady Bird (Life estate) deed on her Florida condo. We were told it wouldn't have to go thru probate it would transfer upon her death to her GRANTEES. Correct?
In Florida, enhanced life estate deeds, often referred to as lady bird deeds, are commonly used to allow real property to pass outside of probate to the remainder beneficiaries. Lady bird deeds have specific requirements, and will not avoid the need to probate other classes of assets. Good question and you are correct. If the bank account had a Transfer on Death (TOD) designation, then that bank account would not go through probate. Thanks for asking!
Many insurance companies are governed under ERISA which means they have a private court that the insurance company runs where you cannot recover legal fees for litigation. If you wish to appeal that decision and take it to a government court then only evidence which was admitted during litigation in the private court, for legal fees which are not recoverable, is admissible. No further evidence is admissible. If the court finds in your favor it may either remand the decision to the insurance company, or order the insurance company to pay. However, the insurance company is immune from punitive damages. Additionally, your lawyer can make you pay 30% of all your past and future benefits to them, not just back benefits, in order to litigate your case in private court, and you cannot go directly to trial and skip the insurance company court, unless the insurance company denies you that process. So, the analogy would be. If somebody wants to rob your bank, you have to pay for the police to protect your bank out of your own money. If you catch the bank robbers the robbers get to administer the court that decides if they are guilty. If they decide they are not guilty you can appeal and take it to the government court, but cannot admit any new evidence. And, if you win, the worst thing that can happen is the robbers have to give the money back. Then, the lawyer who helped you get your money back gets to take 30% of all your business for the rest of your life. That is not justice. That is pure evil.
