    My HOA has several complaints. They complain about my vehicles which have been shown as operable to Code Compliance already. Yet I see at least 2 vehicles that OBVIOUSLY have NO MOTOR! They complain about ground cover and when I asked about the ground cover you said they don't want to argue about it that they just need me to maintain ground coverage but they won't tell me where there is a situation where there is no ground coverage. Is a vague BS charge they WILL NOT be specific about! They complain about my trash cans being left out on non trash days, but they are behind shrubs which are more out of sight than most people's in the neighborhood you cannot even look at my trash cans without seeing my neighbors trash can less than 20bfeet away which has been sitting out there for more than 3 years now collecting mosquitoes all the time. I have over 200 photographs of other people with their trash cans in more obvious plain sight than mine. They sent a letter asking about it... Are you going to bring the trash can in? No. Wht not? I'm having the city swap it for a smaller unit and they said to leave it at the curb. Well don't you think you should let us know? Do I need to let you know every time I fart??? Ever since I am THE ONLY HOUSE PEOPLE LOOK AT EVIDENTLY! I've also had to remove all but 1 room of Bamboo flooring due to leaks & water damage happening consecutively for several different things... I had construction supplies (tile) and other things. They cited verbatim about construction materials until the 2nd part of the sentence which states unless it's for an ongoing or immenent project... But that part is put in the charge as ... Leaving out the exception directly applying to me! Is this not altering the covenant to make me guilty? Is this legal? They left out another charge replaced by ..... What can I do about that? 5S the attorney to address it but he ignores it. I also asked him to address selective enforcement and your attorney says you're being treated like everybody else which is complete BS! A former board member who works with the board still on social events communicating with them daily I've been with any messages to me and told me to put the supplies in the backyard. So even though it was a major inconvenience I went ahead and did it and they were happy with the front yard at this point. Give me my neighbor or board members took pictures of my backyard after that and declined an agreement and $2000 check! I was SET UP!! Before even having knowledge of the declination they immediately sent code compliance to complain about A PEICE OF CARDBOARD IN BETWEEN VEHICLES!;NO NOTICE TO REMOVE IT, JUST CALLING CC! Is this NOT maintaining civil communication and allowing me to rectify??? I think the rules that govern HOAs abuse are great...but if I can't afford a lawyer I can't do anything about it evidently! Also this lawyer took my documents to copy and return .. but he will not return them! To top all of these atrocities...my home is in a family trust (FOR SUPPOSED PROTECTION) and he has ALL CONTROL! YET MY RIGHTS ARE BEING STOMPED TO DEATH! But I can't even bring my evidence! The attorney I FOUND FOR MY DAD & I (HE'S 1500 MILES AWAY) HAS NOW CONVINCED DAD TO EVICT ME! Is this not a conflict of interest? My lady , who is handicapped, and I have both poured our situation to him and he files eviction against us! I'm ABSOLUTELY LIVID!! PLEASE HELP! ANYBODY! PLEEEAAASE!😢🙏

    Along with the comps I like to show them homes still on the market and ones that may have been withdrawn. I know they want the highest price possible but sometimes the number they see on certain online sites is NOT a realistic number for their home based on the condition.

    Do you need a release of earnest money for when you terminate under the option period?

      In Texas the one to four contract states that if the contract is terminated during the option period then the earnest money is refunded to the buyer. Therefore we don't need a release of earnest money.

    We were pre approved for 350k. But we want to make an offer on a 370k house. We have the funds to provide that 20k cash to make up for the difference. Do those 20k count as a down payment? Or are we still required to put more down?

      I believe you would still be required to put more money down, but that is definitely a question for your mortgage lender!

      In Texas the earnest money deposit can't be made on a credit card. So I'm not sure what would be the protocol for that in another state if a credit card deposit is accepted.

    I don’t agree with the housing industry protocol as a veteran that has served I feel your whole industry is money grubbing if the seller is getting the VA home loan money why give the earnest money always gotta insulate the seller the agency but never no incentive to the buyer

      Depositing earnest money is not something that is a money grubbing protocol from our industry. Imagine if you were selling your home? Wouldn't you want to know that the buyers of your home have put money down on the home as good faith? And earnest money is credited to the buyer at closing. That is the incentive for the buyer when putting earnest money down. It's their money and it stays there money when they buy the home.

    I literally had an agent who showed the house and then just left the key in my front door. Not inside the house, but in the door. They had NO idea when I would be back to the house, and while granted it was a very safe neighborhood, that was a bizarre oversight or inconsideration.

    the house flooded after I paid the inspector and I pulled out of the deal. title company lied and said the check was in the mail for 3 weeks. I never got my earnest money back So I called the owners of the title company in florida and they fedex'd my money. they will try anything to keep your money.

      I'd recommend reaching out to your HOA when you do get a violation for your yard and ask them why they sent it to you if you disagree with the violation.

      Thank you. Yes on the CD you will have the breakdown of what your monthly payment will be in terms of mortgage principle, interest on the principle, and if you escrow your property taxes and home owners insurance. Your interest rate will be on the CD as well.

    Great video! (Dumb question) using your example, if the Seller agrees to pay the Buyer the cost of replacing and installing a water heater, how, is that agreed upon amount, dispersed to the Buyer? As a check at the closing table?

      Great question. What the buyer and their agent should do is get quotes to install and haul off the old water heater, then ask the sellers to pay for that full amount. That amount will be signed off on by all parties and that money is given to the buyers at the closing table. Don't forget the cost to haul off the old one that could be a couple of hundred dollars!

      In Texas if the buyer has not secured financing and their financing contingency date has passed then the buyer would lose their earnest money. That's why it's so important for the buyers agent to have this contingency date in their calendar to make sure they have the full approval by then to protect their clients EMD.

    I lived in a neighborhood where trees were planted next to the curb. The trees grew up and caused many problems. The roots found their way into the sewage lines and also caused the sidewalks to buckle. I read that Dallas is in the "flood alley". Is Mansfield subject to flooding? I drove thru TX along the 10 fwy. I could smell a lot of smog in the air. What is the quality of the air?

      There are areas of Mansfield that are in 100 and 500 year floodplains. But that is par for the course for most cities here in DFW.

    Come on down to Waxahachie, Everyone else has. All they are doing is building homes by the Thousands, traffic is worst by the day, if that's not bad enough The train runs through the down town area about 10 times a day It seems like. That's good for a 15-minute delay , most of the Restaurants are packed. Stores Are crazy busy . Not enough Business to support the boom . The roads are packed with bad Drivers, everywhere you turn There is a new giant R.V. park. Soon, Waxahachie will be another Frisco, the though of Going to town is a nightmare. Come on down and add to the Problem. Hell, I might even sell You my home so I can get out Of this man made disaster .

      If the option period is up and they want/need to terminate they can't terminate and cite the option period as their reason, since it's over. They must cite another reason in the contract to terminate.

    Realtors should stop accepting earnest money. Sells should ask for TOM fee. Earnest money can end both parties in court.

      TOM fees aren't written in our contracts. Our contracts are written by the Texas Real Estate Commission. Earnest Money is written in these contracts.

      @DanaeHewittYourGoToDFWRealtor I bought a house in Burlison. I'm pretty sure I didn't put up earnest money. I most likely offered to the owner/agent a quick closing. That house caught fire and is being repaired . I would really like to do a trade for an animal friendly property.

    Hey thank you for your video… I’m a realtor struggling for the first time in my career with getting my client’s house sold. First I made the mistake of going along with the seller’s decision to price high and list in the fall. I’ve had showings and feedback all said either “priced too high or outdated”. I’ve been marketing on social media, email blasts, and staging nothing has worked 😢

      I'd take that feedback you're receiving from showings and present that to your clients, letting them know this is what people in the market are saying. Then pull any recent home sales and show your clients as well. You got this!

    Danae..I need solid good advice. The seller accepted our offer on a home but with contingencies that the septic passed. It did not pass and our contract was over on 2.6.2024 without any extensions or updates to the contract. In the meantime...the seller passed away and my earnest money is being held by a title company as seller did not have a will and the seller is not available to sign the release of earnest money form. Is there anything I can do to be proactive? A form to fill and submit to the courts? Anything to present to the seller's realtor/agent giving like a 72 hour deadline? Or something of that nature? I should not be expected to wait for months to get this money back as we have moved on and are purchasing another home.

      I'd call the title company that you worked with on this home purchase and find out what can be done to receive your earnest money back knowing that the seller has passed away and can't sign the release of earnest money.

      I get it! Showing the inside of the home requires the sellers permission. A lot of times I ask and get pushback, so I show what I can with pictures and the neighborhood. Thanks for the feedback.

    The best way to avoid any HOA nonsense is to tell your realtor that you will not even consider a property that is in an HOA neighborhood. A neighborhood that I lived in tried to form an HOA after I had bought a house there and told me that I had no choice but to be in it. WRONG. Read your civil codes . In my state, if you purchase a house where there is no existing HOA your property is exempt from joining if you choose not to.

    So if the HOA foreclose on a home purchaser that means the HOA is taking over that mortgage being they wasn't in first position on that loan?

      That's a great question that I'm not sure I know the answer to. I hope it doesn't ever get to that point for a homeowner.
