The SSA clearly does not accurately calculate overpayments based on SSA or simple arithmetic laws. SSA sent me many demand letters, each saying I owed a different amount ($61,000; $55,100; $51,500; an amount in the $40,000). 19 days after an administrative Law Judge ruled I had been overpaid $38,211, the same SSA Kansas City Debt Payment Center sent me another letter demanding that I pay $99,490. After pointing out egregious errors obvious to a third-grader, the SSA paid me $13,300 for amounts they over-withheld. SSA cannot possibly back their claims of accurate calculations when the spew out guesstimates like mine that wildly vary.

Sadly she is right but it shouldn't be that way if it's not your fault. If the employee makes the mistake then that's the government fault. Write it off. Only because these are people living on fixed income already struggling to pay their bills. If the applicant lied to get extra money then they need to pay it back.

What if their employees give wrong information made you ineligible for SSDI. That is what happened to me. Was told I could not file while I was in a workman's comp claim. To top it off the lady put down I was receiving money from my mother for rent when I was paying her. This made my SSI pay half of what I was supposed to get and my back pay was affected by it. They awarded 2 years back pay it was broken down into 3 payments. The only reason I started getting full pay was my mother passed away. I went in because I received $2500 from inheritance by the time it was said and done I got a little of $500 but have never received any money over the woman's mistake. SSI was a third of what I would have gotten on SSDI. From the age of 17 I usually worked 2 jobs and was in the reserves.

I injured my back and work this morning. I never smoke before or during work. I usually do it I'm the afternoons after a long day from work. Will i get fired or my case get denied? What can I do to protect myself, i just wanted recovery from my pain, and to get back to work once I was good.

I'm in NY and cut the tip of my finger off at work, I ran right to the hospital to get pain meds so they couldn't test me and my boss was pissed

What if SSA says oh we discovered an overpayment 3 years ago in May 2012 and today is Sept 2015 so you owe us 3 years back pay. After that month in May 2012, your income came down and was consistently down. Since the overpayment was discovered years later and was a rare one-time thing, no one knew it happened OR it was discovered in 2012, dealt with, but files were lost, overlooked, so it looked like SSA never saw the overpayment maybe they lost the paperwork and so they are charging you again with an overpayment. There's nothing in the regulation about finding a one-time overpayment 3 years later. How should it be handled? Shouldn't SSA look at the weeks/months following the overpayment and determine ok it was not a consistent work gain and waiver from that point on? I believe i read that they allow 3 more months of payment and then cut u off if you are over the limit? I was just over about $150-200 that one month and I sent them proof of income monthly.fed taxes. They won't even look at it so I owe 3 years now. How do I fight it? The case was remanded back to the courts and it was find that the SSA lost lots of my paper work they can't seem to find. Odd unusual case but no lawyer wants it because there is no money in it they say.
