    Can I contact ombudsman on my hostel manager and the suitability team as they are both working together and very bias and forcing information that I am suitable in a hostel with a young child

    It would be interesting to hear your thoughts on Tower Hamlets revised Homelessness Accommodation Placement Policy: “Tower Hamlets Council scraps 90-minute distance cap on temporary accommodation placements for homeless families. After removing the distance cap, Tower Hamlets Council will now be able to place homeless families in temporary accommodation that is more than 90 minutes away from the borough.” “The council will use 'zones' to allocate temporary and privately rented sector accommodation for families, ranging from Zone A (Tower Hamlets), B, C, to Zone D (anywhere in the country).” The only guarantee to be placed within the borough is for households with children in their final year of GCSE or A-Levels. No mention of decision criteria or how the policy will apply to single homeless and people with no children. With the new policy, the council will avoid judicial reviews and court’s costs relating to unsuitable accommodation. Will the policy be used as punishment against homeless people, so to deter them from approaching the council (and therefore reducing the council backlog)? And to get rid of the "problem" by sending homeless people further away, with little chance to come back to the place they have local connection?

      we'll discuss this tomorrow (12th September) but part of the answer is that the policy won't trump the law on suitability, so it would still be possible to successfully challenge suitability that is in line with their policy.

    Single homeless people get no help regardless of their mental health conditions, so approaching the council is pointless, the only way is to get a legal aid housing solicitor if you can get one, that what i had to do last year thanks to crisis uk they fought my council even thought they kept rejecting to help me after many months of challenging them they gave up and gave me temporary accommodation. Even thought ive lived in that borough all my life. They were refusing me eventually when i got T.A it was out of my borough

    Hi i got the local.mp yes sent the executives the letters ect . And they are considering placing me in a temporary acomodation as as result as gotv23 points only as been going thro harrasnent stalking ect also they r willing too discuss msybe making my home safe thank u hope thus. Helps with clarifications. Ect

    So the landlord said "they didn't pay their rent because they wanted to be homeless" ? "I wont pay the rent because i want to sleep in that shop doorway". The word "intentionally" is used very wrong by the government.

    The council is using the wrong word. "Intentionally" means you set out to achieve that goal. Nobody sets out to be homeless. Nobody wakes up and says "I'll have a drink today because I want to be homeless" . They need to find alternative words.

      What word do you think would be better to convey the concept? Interestingly the concept first arose as the system enabled people to abandon their home knowing they would jump to the top of the housing list, which makes sense, but it has morphed into something else, and is then misused by councils as they try to apply it to people who don't come close to meeting the legal definition of it.

    Is it worth going to a judicial review against council with a no win no fee solicitor, or go through local government ombudsman or can you do both? If local gov ombudsman has tackled sirepairs and housing application issues before eviction and has found them at fault but post eviction has not been dealt with them as yet. Is it best for get them to do it first then a no win no fee solicitor, or is it quicker to do them simultaneously or just one and not the other? Given that they cannot change decisions, is it better to get a no win no fee to take up judicial review to give the best possible outcome for social housing application and what are the potential costs for losing? Can Will recommend any no win no fee law firms specialising in social housing applications and gatekeeping to go to judicial review ?

    What if housing benefits say that service charge can and should be wavered by the placement officer for those in debt based on affordability and they refused despite escalating to manager. How does one get the council to award points already qualifying for according to the councils own scheme on hardship, overcrowding and time homeless over 6 months. Refusing to engage and imposing arbitrary qualifying criteria for medical review when already qualifying according to their own scheme. The delays are just ruining gcse options for child in hotel over 6 months.

    I have heard nothing dood about Can Temporary Accondation and people who suffers with Mental Health problems it can make it much worst due to the lack of privacy and I also heard the conditions are Terrible too damp and mold and some of the places are over ran with cockroaches and vermin making them unsuitable to live in

    Did a SAR I sent email to chief executive I and my 3 children spent 18 weeks in bb accommodation 12 weeks over the max time I requested 2400 but 8 weeks later no response the local ombudsmen on their website said I must wait 12 weeks for a response then they will get involved. I’m writing the chief executive every week still no response what shall I do just wait or what? Thank you

      You might have to wait if that's what the LGSCO says, but you could involve local councillors now - so you can get their email addresses on the council's website and see which councillors are relevant - there will be councillors who cover where you are living but also who oversee housing and children's services. If you email them, explain the situation and explain you have not heard anything and that you want a response.

    If someone didn’t want to stay for the possession order and wanted to leave after a section 21, due to not wanting extra costs given to them and also having children with needs and in the past has had dv so doesnt want stranger (new potential tenants) looking around will they still be found intentionally homeless?? Also if the council have a duty to help can they only give private sector accommodation or can they give council/housing association etc if local connection

    What if you request a review of your Personal Housing Plan because they have you in private rental scheme and your in a lot of debt and cannot afford private rent or the risks associates & your housing officer says no I cannot? And told however, if you were offered a property in the rental scheme and you refuse then you can request a review. Applicant does not want to delay things further because hotel accommodation is effecting child’s education after tackling year 11 in this environment. 6 months in hotels not acknowledged in stage 1 review which failed. Child’s rights not considered. No access to cooking facilities etc. How do I tackle the stage 2 review. Médical points rejected despite full pip esa and blue badge & daily care. Tried to get MPs involved but not getting any responses. Stage 1 sent to borough CEO

      It will depend massively on your local area's waiting times. You can make a Freedom of Information Request to the council and ask them for the average waiting times for people in your situation.

    I've actually had an update they've placed them into temporary accommodation (a flat) really surprised as they were not in a hotel for long at all. They've given them a section 188 so they agree the person is in priority need right? So the new question is, the Dr deemed them as not fit for work unless adaptations are made in the work place, they haven't been able to find any work where they currently live but have an interview with an employer in a different Borough (bedford) if they do get the job can they make a request to there housing officer to move them to bedford whilst they are in intermin accommodation and how likely is it that this will happen? What documentation will the council require if this does happen Would they then provide the next steps like permanent accommodation in Bedford there after. The council hasn’t updated us to the next steps of how long they will be in the new accommodation. Because they've given them section 188 does that mean it's likely that they will get the main duty and put them in a council flat? Also they're waiting to hear back from housing benefit. They can't afford this place on there own, so how does it work as they sign and take on the flat accommodation rent, but what if the housing benefits turn around and say they cant fund it? Is that likely / unlikely to happen? As the person is homeless and unemployed so cant afford it otherwise.

    I was a housing officer in central London, and I have offered accommodation to people on the Council waiting list, for them to say if it does not have the right to buy I am not interested. I was appalled, is this still their right?

      For sure, without his input I wouldn't be confident that any of the other councillors would have got stuck in. It's partly political as the Conservatives and Lib Dems are publicly taking chunks out of each other so there's no love lost between them.

    Hi hope all is well!! 6 years ago I was placed in temporary accommodation & I had my baby at the time . I was still eligible to bid & I was placed in band 3 , then in 2020 I was offered a temporary property again , but my housing officer didn’t tell me it was a private rental property. I accepted it & I continued to bid, I thought that I was placed in temporary accommodation again by my council rather than private . After 4 years I have finally heard back from the council with a successful bid for a new house . But they said I can’t have the property because I was placed in my current property & it’s private , & they only reached out to me because they thought I still lived in my old address . I have now been placed in band 4 & have lost my right to bid as a homeless home seeker . They only put me in band 4 after I had told them I don’t live there any more My case has not been updated since 5 years . & I was told I was placed in temporary & not private . What do you advice I do now as this is not fair to me ?

    My friend who have autism, ADHD, depression and P.T.S.D., escaped from his father six years ago who abused him severely have been stigmatised by the council from day one. His social worker has retired and not been replaced and still today after several doctors who were given the duty to help him get a new social worker he still doesn't have one. During the first meeting the housing officer judged him as vulnerable and in priority need and the best for my friend would be a self-contained accommodation. He gave his housing officer 4 medical letters from therapist, psychologist and doctors for him as medical evidence, stating why he needs a self-contained accommodation. My friend have never worked and is uncapped and have been living in guesthouses, BnB's for the past six years and is currently couchsurfing, which makes him legally homeless. The housing officer started suddenly question if the papers were inauthentic, each one of them were signed with phone number, email and adress and the housing officer was even invited for a online meeting om microsoft Teams with the doctors and therapist to discuss a solution to his housing situation, but he declined to participate. He kept claiming my friend was benefit capped and therefore he could only be given shared accommodation which were rooms in terrible conditions, no lock on the door, signs of violence, alcohol abuse, things that are bad triggers to his diagnoses. A month ago he sent a screenshot from UC that stated he is not capped to the housing manager who nonchalantly asked if he wants fill another housing application and that my friend would get a different housing officer this time. This was three weeks ago and now the new housing officer have suddenly gone on vacation and will contact my friend once he's back in office! Do you have any advice on what my friends could do to end his nightmare?

    Hi , I made a complaint to the council regarding my case worker , my medical conditions are not taken into consideration and about the hostel , the council replied they’ll get back to me in 15 working days however no reply back and the deadline is also over and I’m so stressed out and I don’t know what to do 😢

      @@meenakaur268 Did you complain to the CEO and copy in councillors? Councillors are usually more helpful than MPs as they have direct authority in the council, whereas the MP is completely separate (although can still apply pressure).

    My friend approached the council with notice to quit in May 2022 they took to Long May 2024 to make falsified one time only offer when the day was up for notification for 184.4 and ignored S199A duties since April 2024.

      @@homelessnessbestpractice meaning when they owed me s199a duties may 10 the forced me to complete another assesment and incorrectly stating no local connection no complex health needs.i did not sign this.then made 5.5 hour offer.

      @@sweetheartgood5970 You might benefit from making a Subject Access Request and looking at the assessment and related documents and showing how it is incorrect. If they said you signed it when you didn't might also be provable through the SAR, meaning you can then challenge it. But given the time scale on all that it would be sensible to pursue a solicitor asap. Will Flack has a list of solicitors which get legal aid for housing cases: wflack.com/list-of-solicitor-firms-organisations-which-carry-out-legal-aid-housing-work/

      @@homelessnessbestpractice greatly appreciative for the link,only have 7 days left to get a solicitor…made SAR and FOI last week,the review meeting minutes and the vote for my case was also requested.. housing function is ignoring now may have to visit the homeless clinic or civic centre which currently avoiding being re traumatised.Can they call the police on me if they owe me duty? Can the police read the paperwork and arrest them for deliberately fabricating offers?

    Council offered me a shared house bed room in private sector ; I accepted it the offer. They did not ask to sign any tenancy agreement.It is available for six month under section 189B(2).Who is pay my rent? Universal credit or Council?     Hello wondering if you can help me. Someone that I know is unintentionally homeless with complex mental health. They have applied to their local council but I actually don’t want to live in the area, is there anyway They can request to move to a different borough. Bear in mind They haven’t even been offered anywhere yet and are still in the relief duty. Also when they contact there local councillor is there anything in particular they should say? Should they just update them on there situation and ask for advice? As well as cc them into emails?

      @@homelessnessbestpractice I've actually had an update they've placed them into temporary accommodation (a flat) really surprised as they were not in a hotel for long at all. They've given them a section 188 so they agree the person is in priority need right? So the new question is, the Dr deemed them as not fit for work unless adaptations are made in the work place, they haven't been able to find any work where they currently live but have an interview with an employer in a different Borough (bedford) if they do get the job can they make a request to there housing officer to move them to bedford whilst they are in intermin accommodation and how likely is it that this will happen? Would they then provide the next steps like permanent accommodation in Bedford there after. The council hasn’t updated us to the next steps of how long they will be in the new accommodation. Because they've given them section 188 does that mean it's likely that they will get the main duty and put them in a council flat? Also they're waiting to hear back from housing benefit. They can't afford this place on there own, so how does it work as they sign and take on the flat accommodation rent, but what if the housing benefits turn around and say they cant fund it? Is that likely / unlikely to happen? As the person is homeless and unemployed so cant afford it otherwise.

    Hi, i need some help regarding homelessness with 4 children and banding for fleeing Domestic violence. I have reached out to so many support networks but no one has been able to help me, i have recently been given your details from a lady on a homeless group on fb. I am currently in EA accommodation (self contained 3 bedroom flat turned into a tiny house) and have been for 2 weeks, i left my last settled private accommodation in Feb 2024 due to DV and have been sofa surfing between family members. I have been accepted as having a full housing duty by my council on the 29th July as i sent multiple emails the day after my relief duty ended to ensure i got the outcome email. My EA they have emailed me the wrong letter i think as they have placed the EA under the s193 act and it states temporary accommodation in the email but when i questioned my housing offcicer with my social worker the housing officer insured us that it was cureently nigjtly let accommodation until a TA property is found. My main concern is my banding though as i have been placed in Band 2 (full housing duty accepted) But i feel i should have been placed in Band 1 (Emergency move due to DV / harrasment / violence) Everytime i ask them to review my banding i am being told no because its not worth the hassle and my banding wont change. But i fit the criteria, i was successful for a auto bid on the homesearch register 2 weeks ago but the property was located in an area that my ex has lots of connections so they allowed me to reject the property was no further implications due to violence/harassment concerns but they wont consider changing my banding. I am really stuck and seriously need some help. My eldest has disabilitys and a OT report and i am under the mental health team and have therapy etc they are aware of all of this. Any help is appreciated massively many thanks

    Please answer this on your live chat - a friend moved to a different area for supported accomodation, joined the register and was given only reasonable preference band E due to no local connection. Since being in the YMCA she has been diagnosed with severe PTSD and is in contact with the mental health team for treatment for this. Could she be re assessed by the council as having a priority need and placed in another temporary accomodation due to the severe impact the current accomodation is having on her mental health?

    I’m about to become homeless on 18th September as I’m being evicted from temporary asylum accommodation in Westminster, London. I have severe Depression, Anxiety, and PTSD, and I’m on medication. I also have a history of domestic violence and sexual harassment, which has made my mental health worse. I’ve got medical reports and evidence from my GP and therapist that detail my conditions and the risks I face without stable housing. I’m really worried about what’s going to happen next. Does anyone have advice on how to approach Westminster Council for emergency housing, especially given my situation?

      Have a look at this video to lay out the steps to take to make a homelessness application. Bear in mind that if you have been in asylum accommodation you need to work out if you are eligible for housing assistance, but that doesn't prevent you from making a homelessness application - it's just that the first inquiry the council will make will be into whether you are eligible for assistance. ruclips.net/video/bb7t8TfWknc/видео.html

    Question 13. The council is doing this to me. They have sent me a "minded to" letter saying to provide evidence basically. For mental health. Im rough sleeping. Should i complain? Im in the process of getting supporting letters.. also, should i send them the supporting letters, or wait until they end relief duty, then challenge it? .. so my priority need decision is made by someone else? Please try answer

    As of Today (22nd Aug 2024) ... Where my friend was refused Homelessness Help 4 times we have now asked Oxfordshire Cherwell District Council for a SAR (Subject Access Request) [times 4 ! so 4 SAR's] ... They replied back next day asking for a copy of his Government Photographic ID (e.g. Passport) and now he has provided his Passport Photos - they have up to 30 days to show us the All Notes regarding his 4 previous applications ... I assume this will make them concerned and now they will start to take him "seriously" for his 5th Application where I am over confident that we can prove he is "In High Priority Need" because on his Printed Summary GP Notes it is clearly stated that he seems to be a walking medical disaster .... then after Hotel Accommodation and the Bidding process to get him housed properly .... the added bonus could be a good 5 figure payment payout just before XMAS as an early present before end of 2024 : - ) ... can you confirm my assumption is reasonable and if so, how likely this will happen?"

    Hi my dad received the section 21 letter and he was told to leave by April 2024 but he Still hasn’t left. And since that letter came he hasn’t received another after April. Is that normal or has the landlord forget about the eviction and he has changed his mind? Or will there be another letter coming in?
