Yes, the federal earnings threshold under FLSA applies to non-profit organizations. Some states may have a more stringent threshold so be sure to check on whether your state has additional regulations beyond the federal rules.

Do you have to pass a number of the questions, or would one pass make them an independent contractor?
Hello and thank you for your question! There is no magic number when it comes to these criteria. Someone doesn’t necessarily have to meet every single one to be considered independent, but the more they meet - the stronger the classification decision. The DOL does weight some of the criteria more than others but they don’t share that info. The key is to really focus on the amount control, the degree of permanence and the skill required to do the work (and whether or not the IC is marketing that skill to other clients or whether it is only you they are working for). Also, as I shared in the video, this ruling is being challenged in the courts so we will make sure to share updates as we receive them. Please explain the 15 minute rounding more thoroughly?
Employers in Michigan must keep records of the total hours employees work each day, clearly showing start and finish times. Time should be tracked to the nearest 10th of the hour (6 minutes). This means rounding up to the nearest six minutes in each hour. The intervals are on the hour (:00), six minutes after (:06), six minutes later (:12), another six minutes later (:18), and so on. For example, if an employee clocks in between 6:58 am and 7:03 am it would be rounded to 7:00 am, but clocking in between 7:04 am and 7:09 am would be rounded to the next six minutes, 7:06 am. If you are in a different state, check the wage and labor laws in your state for the increments. The Fair Labor Standards Act (FLSA) states that three types of time clock rounding are allowed - 15 min, 5 min, and 6 minutes. Generally similar rounding rules apply - similar to the example I provided above. I hope this helps and thanks for your question! Don’t all companies have to offer health insurance? And cover 50% at least of even a high deductible plan? I thought this is part of ACA. Asking for a non profit of about 4 admin staff.

To clarify, the Affordable Care Act (ACA) requires employers with 50 or more full-time equivalent employees to provide health coverage to at least 95% of full-time employees and sets a minimum baseline of coverage and affordability. However, if your small business (with fewer than 50 full-time employees) does offer coverage, then that coverage must comply with the requirements of the ACA. Small businesses with under 50 full time equivalent employees are not required to provide health care coverage. So my employer that rounds to whatever half hour is in their favor is breaking the law.
In Michigan, time should be tracked to the nearest 10th of the hour (6 minutes) or less. If you are in another state or at the federal level, the rounding rules may be different. At the federal level, employers can round in 5, 10, 15, and 30 minute increments as long as it does not hurt the employee. I have been hired in 2008, wondering why my employer is doing an i9 audit on me just now, August 2023.
Employers may do an I-9 audit for a number of reasons - it could be part of a larger HR audit, it could be part of a compliance procedure where some/all of the completed I-9s are reviewed on a regular schedule, or it might be the result of recent changes to the I-9 form and verification process. It doesn’t necessarily mean that something is wrong.

Can the I-9 be verifyed by a Friend or a family member?
The short answer is yes. The I-9 form allows an employer to “designate an authorized representative to act on your behalf to complete Section 2. An authorized representative can be any person you designate to complete and sign Form I-9 on your behalf. You are liable for any violations in connection with the form or the verification process, including any violations in connection with the form or the verification process, including any violations of the employer sanctions laws committed by the person designated to act on your behalf.” So, as long as the person you designate is not the employee themselves, you are free to choose anyone you’d like. However, you (the employer) are still liable for the accuracy and completeness of the I-9 form, including the section the ‘authorized representative’ completed - so choose wisely!

So I have a question on the employee side. I believe I read that employers will no longer be able to front load sick leave. I believe it also states accumulating time is a ratio of 1 hour earned to every 30 hours worked, capped at 72 hours. My question would be can I roll over the 72 hours into the next year and accumulate up to 72 more? Or would it be once I have my 72 that's it. I'm asking this because I'm a full time production worker. I regularly work 56-64 hours a week. My total time off this year was front loaded to 20 hours sick time and 40 hours PTO. Would this give me 40 hours PTO and 72 hours sick leave? Giving me a total of 112 hours instead of my current 60? I guess that was two separate questions 😂
Under the original ballot language of the Earned Sick Time Act, employers would be required to accrue 1-hour of paid sick leave for every 30 hours their employee works. There is no cap on how many hours of paid sick leave an employee can accrue in a year, but there is a cap on how many hours an employee can USE in a year. For companies with 10+ employees, employees can USE up to 72 hours of paid sick leave each year (unless the employer sets a higher limit). For companies with less than 10 employees, employees can use up to 40 hours of PAID sick leave and 32 hours of UNpaid sick leave in a given year (unless the employer sets a higher limit). Employees are allowed to roll over any unused paid sick leave into the next benefit year with no cap, but are limited to taking 72 hours of paid sick leave (or 40 hours of paid leave and 32 hours of unpaid leave for small employers) within that year. Employers would not be required to pay out unused sick leave banks should an employee separate from employment. As for your question about PTO, employers are not required to offer paid time off beyond this paid sick leave mandate, so any additional time off that is offered (in the form of PTO, paid holidays, etc.) can be changed or modified by the employer at any time. My guess is that your PTO bank may be adjusted if additional paid sick leave is required.
