    Now the property was bought 21 years ago it is the son's residence since 2003 . The names on the deed are the parents of this only child son ( both German citizens and living in Germany ) . The last name of the son is the same than the last name of the Parents . The Property is free and clear of any loan.( all is payed ) all taxes are payed as well. The Property is in Arizona ( Pinal county ) the son is an American citizen . He lives at that property for 21 years now , and he also is paying all the taxes, always ahead of time. The parents are getting old now ( late 80th ) and wants to give the property to their only "child" ( an already 62 years old man ). The father wrote all information in English on a paper and went with the mother to one of the best notaries in Germany , because both are German citizen. Everything is notarized, and the parents were sending the origin deed and the origin notarized writing about transfer of property to the son to the USA , Arizona. The son went to a title company and they refused to issue a new deed, because the parents ( barely able to walk to the mailbox ) need to make an appointment with the US Embassy in Frankfurt Germany and have this already notarized paper again notarized from an US Notary in Germany. Some other lawyer said that an apostille will do the same as again notarizing the same writing twice , because there is a contract from 1961 between USA and Germany that if the writing is certified by a court , an apostille can be ordered by mail from the embassy ore some other official notary office , and these old parents do not have to be driven by a driving service to Frankfurt and do not live thru all these hassle. I will get the father's German notarized writing certified from the superior court in Florence Arizona, if you can prove it , that an apostille will also do it , instead of chasing this old parents to the embassy, and if while an appostille can be ordered by mail, you can do this case.     The seller does not have to sign this; this has to be done in good faith, and these attorneys are just taking the "buyer's" word for it. There are severe consequences if the Memorandum is filed maliciously to strong-arm a seller who does not want to sell their property to this particular buyer. The consequences include criminal charges if the encumbrance on the title is not remedied in a timely manner and exposure to civil lawsuits as well. In most cases, these are tools of fraudsters in the hope to take advantage of distressed homeowners, especially minor and migrant homeowners.

    Can the 4 siblings sue the sister that is preventing us from conveying a deed to all 5 names. For over 2 years we been back and forth . Hired an attorney for probate. Cause The will Of our Mother, mysteriously disappeared. My Nephew is the Fiduciary after she again tried to prevent that from happening. She moved in with her son into the 1st floor, of a 2 family home . And Will not pay anything compensate. WE hired a contractor to fix / repairs in the house . She fired the contractor and threaten him to be arrested if he came back to do work. We been paying all the bills from rent coming in from 2nd floor. As of now we can not buy her out , and we all want the 4 siblings to convey the deed to all 5 sibling . And she will not corporate. Can we sue her and what type of lawyer should we be seeking.? And from my understanding we have 3 months to convey deed or surrogate court will take over .?
