11:30 I thought agencies have to respond within 5 business days as to whether or not they'll be able to provide the requested documents. Then they have 30 days to deliver the documents. Is that correct?

Can we do one a RTK/Open Records vid for "Authorities? For example the Bucks County Housing Authority does not list a RTK officer of any kind and seems to be under the impression they're not required to. Under the Right to Know Law a local agency subject to the law is defined as: Any of the following: (1) Any political subdivision, intermediate unit, charter school, cyber charter school or public trade or vocational school. (2) Any local, intergovernmental, regional or municipal agency, authority, council, board, commission or similar governmental entity. The OOR regularly reaches out to agencies to confirm that they are in compliance with the notice and listing requirements set forth in the RTKL.

The Office of Open Records is specific to the State of Pennsylvania. Texas has its own "Public Information Act," and Louisiana has a "Public Records Law."
NOTHIN’ for SUNSHINE 2024??? (Come to think of it did we do anything for 2023? I seem to recall being at/viewing a presentation from a library last year? Cmon PA!! Believe it or not there are many federal & other state govs, non-profs, transparency advocacy groups & a host of orgs that view FOIA & open access through a wide array of legal lenses, look to our Open Records policy & Process as one of only very few that should be emulated when designing novel or even “model” open access policies & procedures of their own.

Thank you for this informative video. The delivery was not complex and simple enough for most to comprehend.
This system to appeal a denied records request is seriously flawed. As most appeals seem to be denied because this office does not care whether records should exist. My own experience with an appeal was very flawed. As the officer extended the time for the agency to submit their evidence without asking me. The deadline passed and they were allowed to still submit their response. Also, one of the affidavits submitted by the agency was full of false statements and I informed the office of such and received no response. In fact, I submitted a rebuttal to the affidavit stating the truth and it was basically ignored. In fact the final determination stated that there was no bad faith on the agency part. Lying isn't bad faith in Pennsylvania? Seriously flawed system basically rules in favor of agency yet makes it out like they care about the person being denied.

If I request information from L&I for a specific property, is the owner of that property alerted? Or can they see that I am requesting information about their property?

Hello, When filing a Right-to-Know Request, an accurate name is required, and we suggest including your address as well. It is not uncommon for requesters to use a P.O. Box as their address. Our township keeps denying rtk requests.
This is proof the Senate are 100% unanimously morons. The majority of the population does not want daylight saving at all, and does NOT approve of this vanity bill! Their thinking is completely wrong. One biased study does not a fact make. Repeal Daylight Saving and restore Standard Time all year, then let the people decide for themselves if the want to start earlier!

To clarify, you mean alternative law/precedent that carry exemptions/exceptions to RTKRQ’s, there by rendering certain records as confidential. Not “protecting” certain information , but “exempting” or “ sealing” certain information….
Still wondering: how is it possible and what to do if the OFFICER look up database on the OOO website lists no more than 5 generic individuals or offices/depts for a PA county, a county with more than 50 separate offices and functional departments. And that’s at the county level. Imagine down to the township etc…
What if a county lists ONLY 6 TOTAL(mostly generic) AORO’s across all depts, agencies, offices, etc? (And reference tool on OOR website has same sparse info ?) thank you team!

If all business in government is in the light of day, can you record the police via telephone on official business if one party knows, making it single party with the police?
You probably want to review Pennsylvania's Wiretap Law before you attempt that.
@@officeofopenrecords3106 I did, including contacting the ACLU and the AG;s office and do not have an answer, I've consulted with 4 attorneys in PA and NOBODY knows. The police should be able to be recorded in their official capacity as transparency is key, be it on the street or on the phone. The courts have ruled that on the street the police are able to be recorded in PA, but the telephone is not addressed either way. This is what needs clarified.
This law while better then Pre-2009. Is still not good enough. Government fails to realize we own you.

Do i need a Right to Know form to get a copy of an officers sworn oath? The chief told me he had to contact his lawyer first for that and filming in the public lobby. Am i wrong in thinking the damn chef should know the 1st amendment even if he doesn't know things like "Freedom of information act" "Sunshine Act" or the "Open government act of 2008" or the half dozen supreme court rulings on that exact thing?? They never reply to my emails and the door (with the unlawful signs and mask mandate signs that they haven't worn once) is always locked. You have to call dispatch to get someone to unlock the door to the public lobby. I was denied access by 2 officers last thursday. Friday when i finally was able to see the chief he told me he couldn't give me the right to know forms till i turned my camera off. I got that statement on my gopro before under duress turning it off. There is some serious corruption for sure and discrimination against me. I was violated on 7/19 when i was told i need written consent to film on my private property, they came on my porch put his hands on me then told me i was detained "till i respected him" all on the camera i was told i couldn't film with. I was 100% conspired against that day and fully believe with pretty good evidence that the 2 police officers were in on it as well. After being violated for filming on my property they allowed a very serious traffic violation to occur by the guy who can be heard on my camera and facebook messenger screenshots i have to be "the muscle/back up" right in front of them. That man was never once at that house ever. A known antagonist who can run amuck everyday terrorizing people. He says these certain cops names and poof no incident.Everytime several of which i have on camera as well. Its like once a week this dude its threatening to kill people in the neighborhood. Last year he spit on my dog and threatened me with brass knuckles unprovoked for playing pokemon in the alley, no incident. 8 cops came 1 stood by me never asked a single question and then they left no incident of course. 5 witnesses also. He gave what looks to be a snitch signal to the copo 10 minutes prior when they drove past before they acted upon me. 3 weeks later i have a summons to appear for disorderly conduct and harassment. I have 8 cameras on that side of my house and one in my hand proving everything in the affidavit is a lie. No articulate reason whatsoever he said maybe 5 sentences and none of which are on that statement. they were with the group for 10 minutes trying to further get me in trouble for a constitutionally protected act on private property. I am in fear for my family and my safety and the cops are in on it. There are only 10 cops in this town 7 of which i know for a fact don't honor their oath cause i have it on camera.

I have a concern about transparency and the efficacy of filing a Right-To-Know with my local municipal governing body. There has been a trend over time and which has rapidly accelerated in recent years and even months to channel major community development projects and initiatives through local 501(c)(3) or other 501(c) organizations that are closely affiliated with and influenced by the local Redevelopment Authority and members of the municipal governing body. Getting information about these projects and initiatives at any time has proven more than difficult if not impossible and usually incurs the ire of those pulling the strings when they are pressed for the information. Whilst municipal governing bodies and Redevelopment Authorities are subject to the Right-To-Know Law in Pennsylvania, the same does not appear to apply to closely affiliated entities that are used by the local RDA and the City governing body to facilitate projects and initiatives the details of which are largely withheld from the community at large. I and many others believe this is a deliberate strategy on the part of these organizations to circumvent the Right-To-Know law. What remedies are available to address this issue?

Monrovile Burrough has denied me copies of grass cutting fines city code enforcement officer had in his hand at the meeting that I was at they also denied me the free-form is an application for a building permit I have no fear of the law because they are above it and I can't seem to find any government agency they can hold them accountable for any of their actions these are just a small taste of illegal actions they have taken against me shortly they will make me lose everything I own

I have no legal knowledge but I did win my appeal, but I know I am going to have to sue for enforcement. I can’t find info instructing how to do that. I hope to do it myself, but I’m afraid I will lose because I don’t know what I am doing.

Very confused about submitting in person. Is your name required? Who can make the request? How long does the records keeper have to comply with the request, if submitted in person? Also how long if records are readily available(literally feet away)? Does there need to be a reason given to see records? May the requester film the process in public buildings or in public access of public buildings? May they film or photograph the requested information?
Also, I read your comment to a viewer. I was wondering what "discretion" specifically refers to and what agencies have this discretion/what does this discretion apply to? It sounds like any public records officer can just say no for no specific reason. Are there any records that can't be shown this discretion?
The RTKL allows agencies the discretion to establish policies whereby they can refuse to accept anonymous requests. Absent such a policy, a requester can choose to withhold their name. The RTKL law allows submitting a request in person. A requester is defined as any legal resident of the United States. An agency must provide an initial response to a request within 5 business days from when the Right to Know Officer received the request, regardless of the location of the records. The agency cannot compel a requester to divulge the reason for the request. Filming the act of submitting a request falls outside of the RTKL and may be governed by local statute or policy. Requesters who are inspecting public records may photograph those records, provided the records are not protected by Copyright. We suggest you take a look at the Citizens Guide on the website.
@@jonnybaze The RTKL is not a confidentiality law - there is nothing in the law that mandates that a record must be withheld. Rather, it provides reasons, or exceptions, that an agency can use to withhold records at its discretion. In order to deny access, an agency must cite the exception. There also may be other laws that mandate withholding records. In that case, the agency must cite the appropriate provisions of that law when denying access.
Office of Open Records thank you very much for the quick response. It seems filing in person would be basically useless considering they have 5 days(possibly 35 days) to respond. Divulging name also seems like a deterrent to demand records requests. Especially if policy dictates it and not law. Filming in public/publicly assessable areas would fall under the 1st amendment and local law(etc.)or policy would be trumped. I was just asking to see if any policy forbids it, which would be unconstitutional. If there are exact definitions of what can be exempt and they have the burden of proof to provide it that's great. I'll research it. I am very disappointed in our state officials for enacting these laws. I would've hoped our laws were the same as Florida's. Not allowed to ask name or reason, must produce information during business hours at a reasonable time and only allowing enough time to get the information and redact any non-public information, with no other discretion allowed.

If the answer to 1 is yes what is the deemed date of filing for the purposes of the 5 business day count down? 3. Can a written request be filed with a City official in the circumstances outlined in 1. for passing onto the AORO and when would it then be deemed to have been filed? 4. In the circumstances outlined below do those days (Mondays, Wednesdays and Fridays) constitute business days or not? "Starting Monday, March 30th, the office will only have staff on Monday, Wednesday, and Friday. The offices are still closed to the public, however on those days someone will be in the office to receive phone calls and work with customers remotely."
I suggest if you are new at this don’t' call the township or agency etc. and ask for a form. Use the form supplied on the open records website. They must accept that form, I'll provide the link. They are not allowed to ask you why you want the information, but be careful they try to find out another way. For example "Can you tell me what you trying to accomplish so I can point you in the right direction". I suggest you do not talk to anyone and just drop the form off in a brown envelope marked "Open Records Request" . Most local townships are very naive about the law, so appeal a denial, its free. displayfireworks1 Using certified mail is a great way to help keep the papers from magically disappearing or claim to never be filed. I'm in the beginning steps of doing this and appreciate the link. Already being harassed, having to go there in person would have me In fear of my life. They've gone as far as to enter my property for no reason and run my plates (that can't be seen in public) then knock to "investigate" my camera system. Drive past my house waiting for me to leave days later the night my insurance expired. I tricked them and it verified my suspicions.

For a public records request, are you always required to submit a physical/digital form or can you make a verbal request to the custodian of the public record?
Verbal requests may be accepted, but it's at the discretion of the agency. Also, verbal requests do not give the requester the right to appeal any denial to the OOR. For those reasons, a written (physical or digital) request is often best, although verbal requests make a lot of sense for commonly available documents such a meeting minutes, copies of agency budgets, etc. More information is available here: www.openrecords.pa.gov/RTKL/HowToFile.cfm
