The testing lab must conform to the ISO 17025 standard for calibration. I do not believe it needs to be a certified calibration lab, just use testing apparatus that are calibrated using that 17025 standard and also conform to the ASTM requirements listed in the UL standards.

When dropshipping this is all way too much, I can only check basic things like FCC, GCC, FDA etc. I need an FCC certificate for my product and I got it from my supplier. But they dont have lab tests for any substances or similar, I guess the chinese manufacturer needs to ask their own material supplier (silicone, ABS) for test reports for materials/and lithium batteries for example. I cannot do anything and testing the products myself is very expensive, what can I do? No person in ecommerce or dropshipping via shopify even cares about this. They dont even care for obvious things like a FCC. It seems like in the US no one has been penalized or caught for this because literally every product shipped to the US is in one or another way non-compliant. Every product is somehow non compliant in some form, so it‘s impossible to do all this

No, the customer is not responsible for ensuring compliance in that sense. But, there is a "disconnect" when it comes to cross border e-commerce as the market surveillance authorities cannot normally reach sellers outside their jurisdiction. Hence, in practice, precautions must be made by consumers buying cross border

Do you agree? Would any regulatory body contact the chinese manufacturer or the person that is on the product labelling if they inspected my product package and opened it and somehow determined that the product might be non-compliant? Sounds all very unrealistic.
Hello, No, I do not agree. We have been contacted by dropshippers that faced investigations, recalls, and fines by market surveillance authorities for selling non-compliant products. This was in the EU though. There is no way that market surveillance authorities would let dropshippers sell unsafe products and do so with impunity because they do not exactly fit the description of a defined economic operator. Further, reaching a supplier in China is difficult, but they can reach dropshippers.

@@ComplianceGate and what about the US? Do you believe getting certificates from the supplier (FCC, GCC, FDA etc.) is a good step to ensure that the dropshipper faces no problems? Because as you said in an article the primary legal responsible party is the manufacturer and importer. A dropshipper isnt either.
@@ComplianceGate you also said that the most that usually happens (in the US) is that the product package is opened by authorities, they determine that the product might be potentially unsafe, and that they destroy it then and there. Because how can they contact the dropshipper and find them when no address of them is on the package? There must be some brand name or similar for them to contact the dropshipper, because I doubt that they would make the effort to contact the customer and ask where they got the product from. So the most realistic scenario is that they destroy the product when it enters the country

Hello, That depends entirely on the product type, age group, and other parameters In short, it's not a matter of filling out a form. You need to ensure that your products are safe, and that often require testing.

Not saying it is generally bad but It's a very strict sweeping legislation that has not been implemented thoughtfully at all. There are many caveats within it which have inadvertently created embargoes on whole categories of items, such as second hand items sold where the manufacturer no longer exists, items that are collectables but not excluded from their criteria, eg trading cards, retro video games & toys (a multi billion dollar market) Product selection will fall in these categories, this will lead to worse competition and higher prices, now the EU consumer & small business will suffer together in ways greater than the existing "harm" caused by these harmless products. They really should have identified risk categories rather than setting a standard across the board, typical EU Council thinking.

Thank you! You are asking a good question. To be honest, I cannot classify a product like this arbitrarily, but it likely comes down to whether this toy is seen as "suitable for children in general" If this would be a Barbie doll, we could never claim that this is a "Barbie for 14+".

No one (or very few) in the US is complying with the AR requirement in (EU)2019/1020. Few reasons for this - (1) most do not know about it, (2) few options for this, (3) no enforcement. Message me if you are available to serve as an AR for electromechanical goods imported into the EU. I work for a US lab with many opportunities for this.

Thank you for the Free information - much appreciated. one question I have though If I, as a manufacturer have CE / GPSR Documentation and I provide this to my Importer / Distributor in the EU region, do they need to "Verify" by also testing the same product themselves using a 3rd party CSPC accepted company at their own cost as well in order to be a compliant seller in EU?
Hello, For starters, CPSC accepted labs are relevant in the context of CPSIA and other CPSC standards - not in the EU (although many of those labs also provide testing according to EU requirements). When it comes to testing, it depends on whether you can provide up to date test reports or not - corresponding with EU requirements. If you can, then it's less likely (not but impossible) that your EU customers would need re-testing. That said, if the test reports are outdated, or the product or material has been modified, then testing could be required.

Ok, so it is more simple than first appears in that if the product is the same as tested and in a recent timeframe that still corresponds to the EU Regulations, then the importer will be fine to use our Docs and Certs. The term "Verify" is quite a loaded one, although, once looked at properly and within the terms above is is simple. Thanks again!

Yes, I think it does - but it is really a case by case situation so I cannot be more specific than that.

What about Parts? Parts of used old laboratory equipment, we have many customers from the EU, that buy from us, they are not labeled with a CE marking does not have a DoC or anything they are electronic parts, would that be excluded? or how ca it be handled?
100,000s of small businesses selling used, vintage items etc (not antiques) will be forced out of business as it is impossible to comply for these items. People will lose livelihoods and stuff will have to go to landfill

Im a small Business owner in Germany reparing/restoring and/or just reselling old Electronics. I feel like the EU wants to do everything in it's power to keep me from doing my job. First this Lucid crap then we were given a tax on our package material and know this. What if I have no idea were my product came from because I bought from some friend or in a flee market or without the original packaging?
Maybe you should stop thinking as a business owner and try thinking like a consumer, who is tired of being sold unsafe, hazardous, toxic & defective products with zero information regarding what materials they contain or how & where they were made. I'm a business owner too but I'm a consumer first and foremost - we all are - and I welcome any regulation that aims to increase transparency, traceability, safety, integrity and conformity, all those things that capitalist societies think they can throw out the window.

Hello Ingrid, The RoHS Directive specifically sets substance restrictions for electronic components. It also covers CE marking and other labelling and documentation requirements. The REACH regulation covers essentially all consumer goods - and sets a far broader range of substance restrictions and reporting requirements There is of course a lot more to say but this is the simplest way I can summarise this just as I am about to head to the office

No, this is only relevant if you sell in the EU (and I think identical requirements still exist in the UK). That said there are similar documents in the US - namely the GCC and CPC.
