    HIPAA law is being abused and is detrimental to public safety. Mass shooters med historys are private. And the connection to the pharmaceutical industry is often there.

    I am really enthralled after getting some subtle information under this comprehensive clips on the context of HIPAA violations. www.legallyfirm.com/hipaa-record-retention-requirements The loss or theft or electronic devices containing or allowing access to PHI is a very common cause of HIPAA violations. If the device had unencrypted PHI stored on it or there were insufficient access controls to prevent unauthorized individuals from accessing the data, this could be very serious. Despite training, policies, and respect for patients’ privacy, a common cause of HIPAA violations is staff accessing records they do not have legitimate reasons to view.

    We are the human being and that's why sometimes we have to face unanticipated penalties because of sudden violation. The aim of HIPAA violation penalties was to keep Protected Health Information (PHI) of patients private. HIPAA offers strict guidelines as to with whom the PHI can be shared, and under what circumstances this is appropriate. www.hipaanswers.com/hipaa-violation-penalties/ Financial penalties for HIPAA violations were updated by the HIPAA Omnibus Rule. $100 per violation has been allowed as a minimum penalty, with an annual maximum of $25,000 for repeat violations.

In some cases, it may determine that the covered entity did not violate the requirements of the Privacy and Security Rules. www.hipaanswers.com/hipaa-violation-penalties/ In the case of noncompliance, OCR will attempt to resolve the case with the covered entity by obtaining: Voluntary compliance Corrective action and/or Resolution agreement Failure to comply with HIPAA can also result in civil and criminal penalties. If a complaint describes an action that could be a violation of the criminal provision of HIPAA, OCR may refer the complaint to the Department of Justice (DOJ) for investigation.

    I had a Hipaa violation on me at the local VA, they are giving me lip service and trying to sweep it under the carpet. I am trying to find a lawyer 2 weeks now but no one will help. Can I file a police report? What do I do now??

    I cannot state in any way that I know of or have met him or either of the commenters at the time this is written. What I can say, is that I hope he was speaking in generalities for his plan is absolutely imbecilic for my condition. I was injured in an industrial accident when approximately 3/4 of a ton of wire fell on me. It instantly exploded a half dozen discs and twisted my spinal cord. I was only offered one operation, not to relieve my pain but, to keep the spinal cord from being severed in case I fell. The surgeon stated before the surgery "this will not relieve any pain, it is just a safety to prevent spinal cord from being severed". Now I would like to know what Dr. Aronoff would have to say about my pain and exercise?!?

    Bill Crounse,MD Head of Worldwide Health Sales published info that's been out there for years about Doctors being able to handwrite their notes on a tablet PC, like the one sold by Microsoft ( Their "Srface" line of computers ). His article "Bill Crounse Right Sized " entices physicians to purchase Microsoft Products OneNote and Surface Computers. Bill Crounse however just retired ond now officially and emphatically states that Microsoft OneNote can not be used as an EMR. Please contact me if you purchased OneNote or A Microsoft computer as a result of advertising by Dr Crounse of Microsoft. Contact me as your medical records may be at risk of being lost and you could be in violation of strict HIPAA rules and reulations. Microsoft Attorney Brien Jacobsen recently stated that Microsoft "Polices" our computer content. This happened to me and I feel an obligation to report this and notify others who may have interpreted Dr Crounse's articles as advertisements. Microsoft is responsible to aid you in protecting your medical records if you are using OneNote as an EMR as reported on Dr Bill Crounse Blog article dated 1/27/2010 still in circulation.     If you think your medical records are safe, guess again. Back in May of this year, my doctor sent a medical authorization requesting my medical records from my old doctor from another state. Unknown to me, my doctor sent all my records to a 3rd party HIPAA certified company who while sending me an unexpected bill to pay for those records to be sent to my doctor ALSO sent me the medical records belonging to someone else.

    Not all hospitals are implementing a true ER. More critical patients are not receiving priority. "Smaller hospitals are using the ER for all areas of seeing and treating patients.

    Anything that can be done to lower malpractice insurance costs is a good idea. We need to start thinking outside the box to address both the rising costs of med-mal and what happens when costs are out of control: Access to care for patients.
