Stategy is very important as you have stated before. The end goal is to hold everyone of these people accountable in a civil action and possibly criminal action. Getting this case dismissed is only a small step to the goal. To reach the goal you will need to strip the judge(s) and prosecutors of their immunity. I think if you go about it in chronological order from beginning to end they will dismiss before you get to present all of your evidence or receive additional discovery that you will need to go after them after your case has been dismissed or found not guilty. By presenting it backward you can show they were all complicit in the conspiracy to commit malicious prosecution. That will strip their immunity and open them up to be charged and or sued later. Witness depositions- Start with the security guard and the Security Director with the wanted poster. Then work your way backward through the student, council members, cops, prosecutors, university personnel, and judges (especially the one who signed the injunction) to the Orielley complainants/criminals/victims and the customers that were outside. Strategy - When the state presents its case it will attempt to show you committed a crime and have the police and Oriellys' liars testify first making false allegations. I would like to suggest showing restraint, skipping the cross-examination and calling them later at the end. Basically let them present their evidence and call their witnesses so you will know what their strategy is. Just enter your objections on the record and present them later when you call the witnesses back up to fulfill your backward strategy. The prosecutor nor the judge will be expecting this. Make an effort to not present each of their perjurys to the court until the arresting officer and the last 2 witnesses and closing arguments. This will lock their testimony in for later rebuttal at which time you want to bring up each false allegation and discredit each witness and the prosecutor's malicious conduct and rule violations. This will accomplish 3 things, 1) it will give the Orielly's employees and cops time to squirm and 2) It will throw the prosecutor off their game plan making them think they are getting by with their ridiculous narrative causing them to let their guard down and most important, 3) gather testimony and enter evidence at the expense of the state for the civil litigation before they decide to dismiss. Possibly even get enough conspiratorial testimony to get a RICO indictment. Let them throw each other under the bus. Have all the witnesses sequestered out of the courtroom while the others are testifying under your cross so they do not know the previous witness just threw them under the bus.
