I have comment on my inbox from an att about this I’ve never heard it till now don’t know where it would have happened at hes saying I have till noon to reply to his notice what should I do?
Thanks for the comment Tammy. Without seeing the notice or comment that is on your inbox, I really can't tell you what to do. Often times, people are given arbitrary deadlines to respond, so it's important to figure out if the deadline comes from court or is just one that the other person is arbitrarily demanding. A call to a local lawyer can probably help clear some of that up for you.
My older brother took my mother to an attorney and made a will and general power of attorney including healthcare power of attorney without consulting other siblings. After we obtained a copy of the documents, my mother had no idea of what was done and immediately asked to redo the will and power of attorney. Can we do a new will and new power of attorney to void the first one ?
Yes you can. Normally, when you create these new documents, there is language at the beginning that specifically says the new document revokes the prior documents.

Andrew - I didn’t receive a complaint with my summons. While I can guess, I don’t have a definitive answer as to why I’m being sued. What now?
You can check your local rules, but in states that allow this (service of just the summons), you often can respond with a document referred to as a demand for complaint that gives them a time limit to serve a complaint on you.

If punitive damages are granted by a State, will summary judgement be discussed between the attorneys with the Judge.
It would probably depend on how they were granted. They could be granted on a summary judgment motion, they could be granted after trial, or they could be granted if the state agrees that they should be imposed. As far as what is discussed between the attorneys and a Judge, that's usually something you'd need to speak to the attorneys in your case about.

I'm going through my first insurance company, and they called saying i will be served from the other party. I just dont know when I want to expect or say when i do should i call now for an attorneys an ask for help or
Being served is often less dramatic than you think it will be. If you are served, you should then get a copy of what you are served with to your attorney (or the insurance company if they will be hiring an attorney on your behalf). You can speak to an attorney now if you'd like, but you may also want to figure out if the insurance company will be providing an attorney first.

I don't know if you answer questions, but I'm wondering If my mother passed, and there's three living siblings and one dead sibling, does it get split between the three living, or does the dead siblings children get what would be his share?
It's a big "it all depends" answer. If your mother had a will, that would say what would happen, but if she didn't, you'd need to look at your state's laws on "intestate" distributions to find out how things are distributed.

I have a lawsuit against the city of ny, note of issue was filed on 01/20/2023, we are on our third settlement conference with out any resolution. Why are there so many conferences if they aren’t interested in settling at all as per my attorney
My experience has been that the Court will try hard to get the parties to settle to avoid the time and expense of a trial, so if that means multiple settlement conferences, it will entertain that strategy.

Are you knowledgeable with setting up other kinds of trusts such as a residence trust, land trust, privacy banking trust, and a charitable remainder trust?
It depends what state you are looking to set the trust up in. The states where I practice (CT, NY, NJ, MN) don't use some of those trusts.

Hi Andrew. Thanks for the video. You have a very mellow helpful way of delivering information. can you please explain in the cases of the ways to avoid probate and whether or not you add the 401k's and retirement investments into the trust, what tax implications they might have. So for instance, If you are a joint owner on a property with family etc, If you put the property into a trust can anyone write off expenses from the home, renovations, repairs property taxes etc? Is there a downside to adding the Retirement accounts to the Trust as the beneficiary of the trust as you mentioned in one of your other videos? Thanks for your help.

What happened if you get sued twice by different plaintiffs then? That would be a whole different situations right?
If they are different parties, then yes, it's not the same person suing twice. Usually the decision from the first case isn't binding on the second plaintiff to sue you unless they were also a party in the other case.

I represented us in a grandparent’s visitation rights, now it went to summary judgment. I’m in Indiana, is there case files I can compare. My daughter died leaving behind my 2 grand daughters which I’m very close to, the adopted mom wants me out of their lives now after being their step mom for 5 yrs. I’m worried I am going to lose my grand daughters

Purchased a mobile home from a lady on offer up. 15,000 down & 10,000 in 10 pymnts. Contract notarized 9 yrs ago. Lady wasnt giving receipts & home was leaking all over & no electricity in half the home. I tried to ask for receipts from owner & she started sending son instead. After 8th pymnt having 2 more left I told her she needed to provide me with receipts & cover half the cost to fix all repairs Im having to do. she split saying she will rtn in 2weeks with answer. She never came back. now its been 9yrs & is taking me to small claims in California saying I failed to pay her 6months of pymnts. She is lying & Im still living in mobile home. Do I need an attorney? How to prepare..court is next month!!!
Unfortunately, I'm not licensed in California, so I wouldn't be able to help you prepare for a court case there. I would suggest you look for an attorney who is local/near the courthouse where the case is and see if they can help you get prepared.

I think it's a shame that Priscilla is so greedy that she would go after money from Lisa's estate to take money from her grandchildren. Money that her daughter has made know she wanted her children to get everything that belong to her and that they got Graceland. Priscilla is a Narcissist and it bad enough she got alot and took from Elvis and enough was never enough for her. Heck she sent Lisa off to boarding school so she could travel around with her men which was alot. That's why she never remarried cause she wanted to get all she could after out of Elvis I mean she has told so many lies about him . He isn't here to defend himself. And just look how. she's did her own daughter Lisa wasn't even gone a week and she was already trying to get what ever she could and her good for nothing son should have never gotten anything from Lisa's estate at all . Priscilla is a piece of trash anyone that takes money away from her grandchildren is pretty low.
what if i wanted the other party to sign a cntract that i have a lawfirm made, and the other party wants his own laywer made contract be signed , none of us want to back down. is there a middle ground ?
There should be a middle ground, but until you find it, you likely don't have an enforceable agreement. Usually, the lawyers will speak to each other and try to work out any disputes over language.
@@ayerslaw yes its about how the wordings are done in the contract, I specified to my lawyer to use a general Subject-verb format and although quite lenghty , it is very clear and unambigous as to the obligations and conditions, the other party hated it and does not want to sign , also some conditions were never fully agreed to, i want a longer project term and spread out payment while the other wants a 40-60% arrangement. We both want the project to push through but we are bogged down by this. so i moved on to other project while im waiting for them to concede, i already talked with other interested parties and its the same issue. I find no court procedure or statute law that mandates a specific party to create and impose a contract document on another, so why should i signe their contract. ( for an engineering & construction project & I am the owner of the property and they will finance the project.) I hate those people. have you come across an agreement with two contract over the same thing ? my lawyer said that would be rare , anyways thanks for the reply Atty Sir. Does accepting the terms of service & making a purchase on an online auction site constitute a legal contract?
Without seeing the specific documents, I can't give you a concrete answer, but as a general question, you are normally considered to have entered into a contract to purchase the item you won on the online auction site.

@@Sir_Emo It's a good idea to have one at least for succession purposes (what happens to the business if you die or become incapacitated). And yes, you can do one in the future and will often need one if you take on investors.

@@eric2k807 It's a good idea to have it in place as soon as possible, but it's not required in most states.
What happens if the llc is already involuntarily dissolved? Do I have to pay something later or I don't pay anything anymore?
@miguelsupreme2390 you'll need to talk to the state where the LLC was formed to see what is needed to reinstate the LLC. Often times, if it was involuntarily dissolved, there are fees to be paid in order to reinstate it.
