    The point of this video is that USCIS posts processing times on its website. I will not deviate from what they say. However, USCIS recently received a big fee increase and we have observed that we are receiving approvals well within the posted processing times.

      @ahmadabdulwahed2912 It depends upon the reason for the filing. USCIS says that it is taking a little over 3 years to process an immediate relative petition. However, I just had one approved thar was a little over 1 year old. As I am trying to say in the video, it is hard to know. USCIS fell way behind in processing all petitions. However, USCIS just received a massive fee increase and I believe that the dam has broken as a result. I am hopeful that this is true and that USCIS just needs to update its website. The true answer is that I don't know and If pushed to answer, I would say Google "USCIS processing times" and check their website.

      Not correct. To keep it simple, all gifts subject to a gift tax return filing count as part of the estate for the purpose of calculating the tax rate of the estate.

      It's easy to do. One thing people do not give enough thought to is how to avoid conflict in the family. My clients say "my children would never fight over money", but the kids are already clawing each other's eyes out at the funeral.

    When I checked on the IRS website about my refund was changed from a refund of $618 to I owe $782 , I was told that I will be getting a letter that was mailed out 3/14/22 it has been 9 business days and I still not received it?I don't think it takes 9 business days to receive a letter through the mail. I suspect that since I did receive my stimulus check of $1400 I should have not put it on box 30 of my return. Does this make sense? What if I never get the letter?

      My guess is that you claimed $1400 for the stimulus, and the IRS says they already sent it to you. Check your bank records to make sure that you did not receive it. If you really did not receive it, you will need to call the IRS and have them trace it. This is a time consuming process for you and for them.

    My 6475 letter says I got 4200 but i didn’t I only received a 600 dollar payment for July than I didn’t receive anything after that but my letter says I got 4200?

      The July payment is different. The $4200 would have come in March or April (possibly May or June). Check your bank records to make sure you did not receive it. If not, ask for it when you file your 2021 taxes. . When the IRS denies it, you will need to call them and have them trace it. This is a time consuming process for you and for them.

    I called the IRS and explained my situation ( I had a summer job with the J1 visa and filled my taxes wrongly as a resident) and they insisted that I qualify for the stimulus check because I have SSN and I should’ve returned the first check and told me not to return the other two🥴 I hear some many different opinions, like not completely trust what they said because they might not be well trained. This is so confusing, I really don’t want to get in trouble 🥴

      The IRS has its own definition of "resident alien" that is based solely on time spent in the United States. It has nothing to do with immigration status.

      Assuming that there is an estate to probate, a Personal Representative needs to be appointed. If the person who paid wants to be reimbursed. By the estate, that person needs to provide whatever documentation is necessary to the Personal Rep. To get reimbursed. The Personal Representative is required to provide an accounting to the heirs a d the Probate Court, and that accounting can be challenged by the heirs. The funeral home does not have to talk to whoever walks in off the street,. However, the person who wants to be reimbursed needs to make this information available.

      The IRS has not given us any guidance on this. I would encourage people in our situation to file ASAP, but beyond that I would just be guessing.

    Thank you for the information. You mentioned that if we are using the long form then we are probably doing something wrong. Our company has been able to keep our doors open and retain all 30 employees at their normal pay and hours. We do have 1 employee who made just over 100k in 2019, doesn't this mean that we must use the long form?

      No. You treat the employee making just over 100K as if he made 100K. You should have done that in the original loan application and you do it again in the forgiveness application. I suspect you are looking at the section that excludes employees making over $100,000 a year from the 25% wage and salary reduction rule. That is a bit confusing, and I suspect will change. However, merely having an employee making over 100K does not make you file a long form. You have done everything the SBA wants you to do in maintaining your payroll. The long form is for people who have not, even with all of the safe harbors the SBA has added.

    I am on H1B and my wife is on H4. My kids are US citizens. Family of 4. We did not make over 200K last year. We submitted taxes too and received the Return. We are yet to get the check. I am thinking this is because my wife had ITIN in the past but she has SSN now. However, when we filed the taxes for 2019, I forgot to put in her SSN and the software (Taxslayer) just pulled the previously used ITIN. How can I have this corrected. It was an error. SInce the IRS is not open I cant call anyone to talk. Taxslayer said that they can't help since the tax return is already submitted and processed. Can you please suggest what I can do. BTW, does your law firm give guidance on SBA loans for foreign nationals. Thanks

    If you follow the instructions and calculations there is no place to calculate out the EIDL grant amount in the Forgiveness Amount calculation. Do you see something I do not?

      I realized that after recording and mentioned it in my video description. Although this is not showing on the form, there has been no other indication that the EIDL grant does not offset the PPP forgiveness. In fact, all commentators are still saying this. More importantly, I do not believe that SBA has the discretion to change this. As such, your reading of the application is correct, but for now I stand by my analysis. A new Interim Final Rule will be announced and I would love to be told that I am wrong. If I am, I will repost.

      I knew I saw it somewhere. It is in the instructions for the form: "Line 11: Enter the smallest of lines 8, 9, or 10. Note: If applicable, SBA will deduct EIDL Advance Amounts from the forgiveness amount remitted to the Lender. "

      @@attorneyhaskell16 Thank you! I had a client mention you could use PPP proceeds for back rent and mortgage interest incurred prior to loan approval. My understanding is that they are correct, you can USE PPP proceeds for these causes but they would be considered non-forgivable if incurred prior to loan disbursement to the borrower. What is your understanding of same?

      You must apply with a bank for a PPP loan. Each bank has its own procedures.

      I am assuming you have no employees. If you do, you can still qualify for a PPP loan using their wages and salaries. As for you, SBA seems to rely solely upon line 31. If you have a banker you work with, you can see if they are willing to go to bat for you on at least the idea of backing out depreciation and perhaps some aspects of standard mileage and the like. The problem there is two step. One is convincing a bank they want this aggravation and then them taking the argument to SBA. I doubt you can fill that inside straight.

    Great video. There are still many holes in the law. I work with several fast food restaurants with constant turnover. You can always find someone to fill jobs to obtain FTE headcount. My biggest frustration with PPP is with Wage Reduction. The government seems to think that nobody ever quits their job. Stops coming to work with no explanation. Job abandonment. You send a email documenting that you have open positions. Please come back. Silence. But the restaurant gets punished with a reduction in wage for them not coming back. It can add up to thousands. You have to document that they refused. Is silence a refusal?

      Save that email. That you are hiring people and begging them back should keep you from being penalized on the head count. At least that is the idea behind the form. You may want to send the disappearing employee a follow on email saying you emailed and they did not respond. That is not proof that they did not respond, but it is pretty good evidence. However, if you keep your head count up and your overall payroll up, you have a good argument for the fact that quitting employees should not hurt you. Maybe I will dig into the long form. I probably will not do a video on that before next week though.

      Did you file a regular 1040 or a 1040NR ? I have avoided discussing the IRS' standard for determining whether a person is "resident" or "nonresident", as it is a bit convoluted, and most people who work here are here more or less year round.
