This is misinformation. They're not suing over copying models. That's copyright infringement. They're specifically suing over patent infringement, which have images shown in the lawsuit. It's the throw ball, battle start mechanics.
That's why i mention that these patent extend to Gameplay Mechanics and Designs not only models <3

I'm gonna take a wild guess and say it's not only pokemon games, and that's why it took this long for them to get their lawsuit ready to serve
