Seems that the basis of this video pertains to the commission described in the MLS listing--although that percentage no longer is acceptable in Cali. Please advise.
Correct, this video is from Jan 2023. Pre-commission lawsuit settlement.

Just curious if it would be possible to add into a buyer escalation clause that if the offer is accepted, that the seller agrees to abide by the appraisal price and if that ends up being a lower amount the seller would have to sell it at that amount of the appraisal.

this form is actually great for the situation where a listing is offering a low fee, and will be standard soon since CAR is making the Buyer rep agreement a requirement soon.

Just to be clear, this SPBB form IS needed if the home has not yet been listed on the MLS to define the amount seller/seller's broker shall pay to the buyer's agent. Correct?
If a listing contract is in place and it’s just not yet on the MLS, use form CBC and check #4. If no listing contract exists, use form SP (Single Party).
What about when the listing agent is offering a flat $100.00 thru MLS? Would you use this form? Not hyperbole, I have see this in my area.
You can definitely use this form, just make sure you also have an Exclusive Buyer Agreement in place.

I got this today with Sellers Multiple Counter ...So if the sellers do not close on their replacement property by the time of COE on the one they are selling (buyers want to get moved in) can buyers back out? Or does escrow remain open on Sellers property until they find replacement? Does the buyers counter have to include rent back, or a date sellers must move out, in case buyers need to move in sooner than later.. I just was introduced to this form today. It is kinda a scary form for buyers, as if the sellers can stay on property until the close on their replacement property...
So if a buyer accepts it, can they back out before the contingency is removed (if they find a new property)?

@@JoshPainterDrums got an sprp from sellers, they want 120 days. I don't think they'll get offer accepted on a new home with 120 days so don't want my buyers to be stuck. Trying to get them sell and get 2 months rent. They have better chances buying a new one with cash in hand.

If you don't expose the max, in theory you would then be agreeing to any price that is higher than a competing offer. That's why we indicate a max. Because it's only triggered with a verified competing offer. And yes you can back out if you don't.

how do you make subject line #2- (C) reflect accordingly if my buyer has a selling home with all CR conditions removed already?
So #2 only relates to offers you are competing with, and those offers being contingent. If your buyer is selling a home with contingencies removed, that would be addressed in your offer, not on this addendum. Hope that helps. :)
