Miranda did not have the right to counsel under the 6th Amendment during his custodial interrogation because he was not in a criminal prosecution and was not formally charged yet. You may want to correct this part of the video. The right to counsel under the 6th Amendment will only attach after a formal charging. Under the Fifth Amendment, a person who is in a custodial interrogation by the police may have an attorney present during the interrogation. However, this right must be asserted by the person under custody. That is the difference between the 5th and 6th Amendment, because once someone is formally charged with a crime that carries 6 or more months in prison, the right to counsel AUTOMATICALLY attaches. Nonsense. You always have a right to private counsel paid by private funds. I believe you mean the right to free public counsel paid by the state. There's a difference. And if the counselor is paid by the State, do they truly have the Defense interest?
@@CharlesLee-es8jr and by the way, as someone who is going to be a public defender, yes public defender’s always have their client’s best interests at heart. They work for the state only because they are funded by the states. It’s literally a public defender’s job to make sure the cops, prosecutors, and judges are adhering to constitutional principles.

@@CharlesLee-es8jr this is not true at all. You never have a constitutional right to private counsel paid by private funds. Private funds means your own pocket. If you can’t afford one, you need to meet the requirements of indigency, and then you get a public defender. There is a difference between fifth and sixth amendment right to counsel as I stated above. I do have my juris doctorate so I do know what I am talking about. You can do your own research, there’s plenty of case law on it. But the right to counsel when you’re being arrested does not automatically occur, you must invoke that right and say “I want my attorney.” They won’t get one for you lol. Cops are legally allowed to lie and deceive you, which is why you must always invoke that right. Feel free to read US v Seay where all of this derives from.

Show me the law saying an independent man or woman CANNOT hire their own private outside counsel at any point during any public or private proceedings? And the right to a public government paid attorney is nowhere in the US Constitution or in any of the founding fathers' writings, it's an interpretation of Liberal Judges namely the Earl Warren Supreme Court.

This needs to be a case ever person knows about, especially if they go before a school board, city council, county supervisors, etc. You have the legal right to openly speak aggressively against public officials, even if they don't like it, so long as you are speaking against their actions and policies, not their person (no ad hominin attacks).
