Hahahaha, if only you researched who we are and what we do. We have been doing car finance claims since 2022. Have won in court over 500 cases for clients. Martin Lewis is scratching the surface with his knowledge on car finance mis-selling. He’s great at teaching people how to save £10 at the local Asda. But maybe leave real scandals to the people who actually know what they are doing 🫡👍

We are saying that the commission element was never disclosed to the client, so therefore should never have been allowed. Which is what the court of appeal have said, that the lenders needed the fully informed consent of the client in order to pay a commission.

The commission element should be a massive conflict of interest. Although you’d expect most people would go through a bank or a breaker for the deal. Rather than deal with a loan through the dealer. Especially given how shady of a reputation those deals have

@ They don’t have the best name for themselves. Car finance works differently to car loans, the interest can be rebated if settled early. It is also tied to the car, so you have Voluntary Termination rights. Also, the car dealer has a fixed APR due to the elimination of the rate corridor. This means the broker/dealer will earn the same, regardless of whether the consumer knows that amount or not. However, I can see how the conflict of interest comes into play if the finance is deemed unsuitable for the customer’s situation.

That’s the way it should be. All commissions declared in full as well as any conflicts of interest that would make the broker unable to be impartial.
